HeyCall Terms & Conditions

1. Introduction

Welcome to HeyCall (“Company,” “we,” “our,” or “us”). These Terms & Conditions (“Agreement”) govern your use of HeyCall’s AI-powered customer engagement services, including but not limited to AI call handling, messaging, scheduling, and integrations (“Services”). By accessing or using HeyCall, you agree to comply with these Terms & Conditions. If you do not agree, you may not use our Services.

2. Eligibility & Account Registration

To use HeyCall, you must be at least 18 years old and capable of entering into a legally binding agreement.

You must provide accurate and complete business information during registration. You are responsible for keeping your account details secure.

We reserve the right to suspend or terminate accounts that provide false or misleading information.

3. Subscription Plans & Usage Limits

HeyCall operates on a monthly subscription model, where each plan includes a set number of estimated AI call minutes, customer messages, and emails as advertised at the time of purchase.

Once these limits are reached, you may need to purchase additional credits to continue using the Services.

The Unlimited Plan is the only plan that does not require additional credit purchases for continued usage.

Subscription fees are non-refundable and billed on a recurring basis unless canceled prior to the next billing cycle.

HeyCall reserves the right to update pricing, service limits, and features at any time with notice to active subscribers.

4. AI Performance & Limitations

HeyCall’s AI is trained based on the information provided by the user during onboarding and updates. The accuracy and effectiveness of AI responses depend on the quality and completeness of the data provided.

While we strive to maintain high-quality AI interactions, HeyCall does not guarantee 100% accuracy in responses and is not liable for incorrect, misinterpreted, or unintended communications.

AI-generated responses should not be used for legal, medical, financial, or any regulated advice without proper human review.

5. Compliance & Regulatory Requirements

A2P 10DLC Compliance (US Customers Only):
U.S.-based businesses must undergo A2P 10DLC verification to use HeyCall’s SMS services. This is an industry requirement mandated by U.S. mobile carriers and not controlled by HeyCall.

Failure to provide accurate business details for A2P verification may result in delays, restrictions, or denial of SMS functionality.

Users are responsible for ensuring their use of HeyCall’s messaging services complies with TCPA, GDPR, CAN-SPAM, and other applicable regulations.

HeyCall will not be held liable for compliance violations resulting from user misuse or failure to adhere to messaging regulations.

6. SMS Messaging Terms

HeyCall Messaging Program

When you opt in to receive SMS communications from HeyCall, you can expect messages related to: service alerts, appointment reminders, customer support notifications, promotional content (with consent), and account-related updates.

  • You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

  • If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to contact@heycall.ai.

  • Carriers are not liable for delayed or undelivered messages.

  • Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

  • For privacy-related inquiries, please refer to our Privacy Policy.

7. User Responsibilities & Acceptable Use

You agree to use HeyCall’s Services only for lawful and ethical purposes. You may not:

  • Use HeyCall to send spam, fraudulent, misleading, or illegal messages.

  • Use AI-generated responses to impersonate another person or entity.

  • Interfere with or disrupt HeyCall’s Services, including overuse of resources.

  • Violate any data privacy laws, including but not limited to GDPR and CCPA.

  • Use HeyCall for high-risk applications where errors could result in serious consequences (e.g., emergency services, legal communications).

  • Sell, resell, or sublicense HeyCall Services without explicit written permission.

8. Data Privacy & Security

We take data privacy seriously and implement industry-standard security measures to protect user information.

By using HeyCall, you consent to our collection and processing of necessary business and customer interaction data as outlined in our Privacy Policy.

HeyCall does not sell personal data to third parties.

Users are responsible for ensuring their use of HeyCall complies with their own data protection obligations.

9. Service Availability & Downtime

While we strive to provide uninterrupted service, HeyCall does not guarantee 100% uptime. Planned maintenance, unforeseen technical issues, or third-party service outages may impact availability.

HeyCall is not responsible for damages, lost revenue, or missed leads resulting from service disruptions.

Users will be notified of scheduled maintenance whenever possible.

10. Limitations of Liability & Disclaimers

HeyCall is provided "as-is" and "as available", with no warranties of any kind, express or implied.

HeyCall and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or reputational harm.

HeyCall is not responsible for the actions, decisions, or outcomes based on AI-generated responses.

Total liability for any claim related to HeyCall’s Services shall not exceed the total amount paid by the user in the last 3 months of service.

11. Subscription Cancellations & Terminations

You may cancel your subscription at any time, but no refunds will be issued for unused portions of a billing cycle.

HeyCall reserves the right to suspend or terminate accounts that violate these Terms & Conditions.

HeyCall is not responsible for data retention after an account is terminated. Users should back up any necessary data prior to canceling.

12. Intellectual Property & Licensing

HeyCall retains all intellectual property rights over its software, AI models, branding, and proprietary algorithms.

Users are granted a limited, non-exclusive, non-transferable license to use HeyCall Services in accordance with these Terms.

Unauthorized use, reproduction, or redistribution of HeyCall’s technology is strictly prohibited.

13. Changes to These Terms

HeyCall may update these Terms & Conditions periodically. Continued use of the Service after updates constitutes acceptance of the revised Terms.

Users will be notified of significant changes when applicable.

14. Governing Law & Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the laws of Austin, Texas, USA.

Any disputes arising from these Terms shall be resolved through binding arbitration in Austin, Texas, USA, except where prohibited by law.

Users waive their right to participate in class-action lawsuits against HeyCall.
